Terms and Conditions of Business

Contract for Photographic Services

These Terms and Conditions apply to all photography services provided by Captured by Cheryl Photography.

By booking a session, you confirm that you have read, understood and agree to the following terms.

1. Acknowledgement and instructions

Thank you for choosing Captured by Cheryl Photography to look after your photographic needs.

Prior to your session, you may inform the photographer of any specific images you would like captured. While every effort will be made to accommodate requests, the final content, composition and style of the images remain at the discretion of the photographer.

2. Product and service commitment

All images are professionally edited and post-processed. Unedited or RAW images are never released.

As a creative professional, Captured by Cheryl Photography will select a final gallery of images based on artistic merit, expression and overall quality. Typically, this will be between 10–20 images, depending on the session.

Due to the nature of working with babies and children, it may not always be possible to capture every image requested. The photographer cannot guarantee specific poses, expressions or cooperation from children. Parents and guardians remain responsible for the care and supervision of children at all sessions.

3. Liability

Captured by Cheryl Photography takes all reasonable care in the delivery of services. However, liability is limited in the following circumstances:

No liability is accepted for loss of images due to equipment failure, postal loss or circumstances beyond the photographer’s control
No liability is accepted for dissatisfaction based on the personal taste or opinion of third parties
A fee may be charged for the retrieval of archived or deleted images, where possible

4. Cancellation and rescheduling

Clients may cancel a session at any time. Any fees or deposits paid are non-refundable.

If you or your child are unwell, please provide a minimum of 24 hours’ notice to reschedule your session. Where less than 24 hours’ notice is given, or in the event of a no-show, a rebooking fee may apply.

If Captured by Cheryl Photography is unable to proceed due to illness, injury or circumstances beyond reasonable control, every effort will be made to reschedule the session.

5. Timescales and delivery

There is no guarantee that a specific number of images will be produced.

Images are usually ready for viewing within two weeks, although this may be extended during busy periods.

All printed products are professionally produced. Canvases are handmade and delivery times may vary depending on order size and supplier timescales.

Due to the bespoke nature of photographic products, all orders are non-refundable.

All bookings are non-transferable.

6. Image storage and deletion

Final images are retained for up to six months following your session. After this time, images may be permanently deleted without notice.

Clients are advised to back up purchased images promptly after delivery.

7. Payment and copyright

The photographer retains full copyright to all images unless otherwise agreed in writing.

Session fees are payable at the time of booking. Payment for additional prints or products is required at the time of ordering after image viewing.

8. Use of images (model release)

By agreeing to these Terms and Conditions, you grant Captured by Cheryl Photography permission to use images from your session for portfolio, website, social media, marketing and advertising purposes.

If you wish to opt out of image use, this must be requested in writing prior to your session.
